These Terms and Conditions of Service ("Terms") govern all transportation, project cargo handling, freight forwarding, customs clearance (PPJK), heavy haulage, barge chartering, and warehousing operations performed by PT. DSK Transportasi Indonesia ("DSK Logistics", "Company") for its commercial clients ("Shipper", "Client", or "Consignor").
Issuance of a formal quotation, booking confirmation, Delivery Order (Surat Jalan), or Bill of Lading constitutes full acceptance of these Terms by the Client and any party having a legal interest in the cargo.
The Shipper warrants and declares that:
For oversized or overweight shipments requiring modular multi-axle trailers, lowbeds, or dolly configurations, DSK Logistics performs formal engineering route surveys covering bridge tonnage ratings, overhead cable clearances, turning radii, and road civil structures.
Execution of movement is contingent upon the formal approval of statutory permits issued by the Indonesian Ministry of Transportation (Kemenhub), road operators (Jasa Marga / BPJT), and police escort arrangements (POLRI / Dishub). DSK Logistics reserves the right to adjust transit schedules in response to governmental road closures or bridge weight recalculations.
Where transportation involves maritime transport, Landing Craft Tank (LCT) beach landings, or tug and barge charters:
Standard allowable loading and discharging durations (free time) will be specified in each formal quotation. In the event of delays at project sites, loading berths, or customs inspection terminals attributable to client documentation delays, demurrage and equipment detention charges shall accrue at daily published tariff rates.
DSK Logistics exercises professional maritime and freight care at every stage. However, the Company's statutory liability for cargo loss or physical damage is limited to standard terms defined under the Indonesian Commercial Code (KUHD) and applicable international conventions, unless a higher declared value has been registered in writing and supplemental marine cargo coverage has been arranged.
Clients are strongly advised to secure comprehensive "All-Risk Institute Cargo Clauses (A)" marine and inland transit insurance covering full replacement value from origin to final installation foundation.
Invoices are payable in Indonesian Rupiah (IDR) or agreed contract currency within the credit duration established in the formal service agreement. Freight quotations exclude statutory Value Added Tax (PPN 11%) and customs duties, which are billed in accordance with prevailing Indonesian fiscal law.
These Terms are governed by and construed in accordance with the laws of the Republic of Indonesia. Any dispute arising out of or in connection with these Terms shall first be resolved amicably through good-faith consultation between executive managements. If unresolved within thirty (30) days, disputes shall be submitted to arbitration under the rules of the Indonesian National Board of Arbitration (BANI) in Jakarta.
